Welcome to Just Breathe! These Terms of Service (“Terms”) govern your access to and use of the Just Breathe application and any services provided by Verve Foundry (the “Company”, “We”, or “Us”). By downloading, accessing, or using our application (the “App”), you agree to comply with and be bound by these Terms. Please read them carefully before using the App.

  • Fees are non-refundable, except as required by applicable law.

Just Breathe is designed to help users with breathing exercises and relaxation techniques. However, it is not intended to diagnose, treat, cure, or prevent any medical conditions or illnesses.

  • No Medical Advice: The App provides general health and wellness-related content intended for informational and educational purposes only. The content is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or another qualified healthcare provider with any questions you may have regarding a medical condition.
  • Use at Your Own Risk: You acknowledge that your use of Just Breathe is at your own risk. Verve Foundry is not liable for any injury or health-related issues that may result from the use of the App. Any use of the techniques, exercises, or suggestions provided within the App is at your sole discretion and responsibility. If you experience any discomfort or adverse health effects while using the App, discontinue use immediately and consult a healthcare professional.

8. Content Ownership and License

  • User Content: You retain ownership of any content that you upload or submit to the App (“User Content”). By submitting User Content, you grant us a worldwide, royalty-free, and non-exclusive license to use, distribute, and display it within the App to improve services.
  • Company Content: All content, including graphics, text, images, and software provided by Verve Foundry within the App (“Company Content”) is the intellectual property of Verve Foundry and protected by applicable copyright laws. You may not copy, modify, or distribute any Company Content without prior written consent.

10. Termination

The App is provided “as is” and “as available,” without any warranties, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Verve Foundry does not guarantee that the App will be error-free or uninterrupted, nor does it guarantee the accuracy or reliability of the information within the App.

12. Limitation of Liability

To the maximum extent permitted by law, Verve Foundry shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use or inability to use the App, even if Verve Foundry has been advised of the possibility of such damages. This includes any health-related claims arising from your use of the App. Your sole remedy for dissatisfaction with the App is to stop using it.

13. Indemnification

You agree to indemnify and hold Verve Foundry, its affiliates, officers, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the App or any breach of these Terms.
